The following history tells the story of one of the epics of English speaking Legal History, the struggle (1956 - 1980) to have the question of the constitutional validity of the Commonwealth of Australia’s aid to church schools heard before the Australian Full High Court. Australia’s State Aid to Church school experience offers a lesson - a cautionary tale for the world, both present and future, that church-state entanglement tends to undermine the integrity of the three arms of government: judicial, executive, and legislative; and tends to degrade religion.
